Regina's Loving Arms Home Health Care, LLC ("Company," "we," "us," or "our") is a licensed home health care agency located at 2020 N Lincoln Park West, Suite 18H, Chicago, IL 60614. We provide home health aide, live-in care, companion care, and related health and personal care services to clients in the Chicago metropolitan area.

As a provider of health care services and a covered entity under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), we are legally required to maintain the privacy and security of your Protected Health Information, to notify you of our legal duties and privacy practices, and to abide by the terms of this Notice currently in effect.

2. Information We Collect

We collect personal and health-related information necessary to provide, coordinate, and improve our services. This may include:

• Contact & Identity Information: Full name, mailing address, telephone numbers, email address, date of birth, gender, and emergency contact details.
• Protected Health Information (PHI): Medical history, diagnoses, treatment plans, medications, physician orders, functional limitations, insurance information, and any other health-related data required to plan and deliver care.
• Payment & Insurance Information: Medicare or Medicaid beneficiary identifiers, private insurance policy numbers, billing and payment records, and Social Security numbers where required for billing purposes.
• Employment Information (Applicants): Resume, credentials, licensure information, references, and background check data collected from prospective employees and contractors.
• Website Usage Data: IP address, browser type and version, pages visited, time on page, and referring URLs collected automatically via cookies and similar tracking technologies for analytics and site improvement purposes.
• Voluntary Communications: Any information you submit through our contact form, email correspondence, telephone calls, or in-person interactions with our staff.

We collect information directly from you and your authorized representatives, from referring physicians and hospitals, from government program administrators, and — with your authorization — from other treating providers.

3. How We Use Your Information

Under HIPAA, we are permitted to use and disclose your PHI without additional authorization for the following core purposes:

• Treatment: To coordinate, provide, manage, and continuously improve the care and services delivered to you or your family member, including communication with other members of your care team.
• Payment: To verify insurance eligibility, submit claims, obtain payment, and manage billing for services rendered to you through Medicare, Medicaid, private insurers, or private-pay arrangements.
• Healthcare Operations: For internal quality assessment and improvement, staff training and supervision, legal and regulatory compliance, accreditation activities, and overall business management.
• Care Coordination & Communications: To respond to your inquiries, schedule and confirm services, send appointment reminders, and communicate about your care plan.
• Legal Compliance: To comply with applicable federal and Illinois state laws, regulations, subpoenas, court orders, and mandatory reporting obligations.
• Safety: To prevent or lessen a serious and imminent threat to the health or safety of you, another person, or the general public, in accordance with applicable law and ethical standards.

We do not sell, rent, or trade your personal information or PHI to any third party for marketing purposes. Any use or disclosure of PHI beyond those described above requires your prior written authorization.

4. Your HIPAA Rights Regarding Your Health Information

As an individual whose PHI we hold, you have the following rights under HIPAA. To exercise any of these rights, please submit a written request to our Privacy Officer using the contact information in Section 11.

5. Permitted Disclosures of PHI

In addition to the core uses described above, HIPAA and Illinois law permit us to disclose your PHI without your written authorization in the following circumstances:

• To other healthcare providers directly involved in your treatment, including physicians, specialists, hospitals, pharmacies, and therapists.
• To insurance companies, Medicare, Medicaid, or other payers for the purposes of payment processing and claims adjudication.
• As required by applicable federal or Illinois state law, including mandatory reporting to public health authorities, child protective services, or adult protective services.
• To public health authorities for disease surveillance, reporting of adverse events, and product safety recalls, as permitted or required by law.
• To law enforcement officials in response to a lawful court order, warrant, subpoena, or as otherwise required or permitted by applicable law.
• To avert a serious and imminent threat to the health or safety of you or another person, consistent with applicable law and professional ethical standards.
• For oversight activities, including government audits, inspections, and investigations relating to the health care system or government benefit programs.
• To our Business Associates — vendors and contractors who perform functions on our behalf — who are contractually bound by HIPAA-compliant Business Associate Agreements to protect your PHI.
• For the purposes of organ and tissue donation, military and veterans' activities, correctional institution activities, or research conducted under appropriate privacy protections, as permitted by HIPAA.

Any use or disclosure of your PHI that is not described in this Notice requires your specific written authorization. You may revoke a written authorization at any time by submitting a written revocation to our Privacy Officer, except where we have already acted in reliance upon the authorization.

6. Illinois Law — Additional Protections

In addition to federal HIPAA requirements, we comply with all applicable Illinois state laws that provide equal or greater privacy protections. Key state law protections include:

• Illinois Personal Information Protection Act (815 ILCS 530): We implement commercially reasonable security measures to protect your personal information. In the event of a data breach involving your unencrypted personal information, we will notify you in the manner and within the timeframe required by Illinois law.
• Illinois Mental Health and Developmental Disabilities Confidentiality Act (740 ILCS 110): Mental health records and information are afforded the highest level of confidentiality protection under Illinois law and will not be disclosed without your specific written consent, except in the limited circumstances permitted by statute.
• Illinois AIDS Confidentiality Act (410 ILCS 305): HIV/AIDS status and related records are strictly confidential and will only be disclosed with your express written consent or as expressly permitted by this statute.

• Illinois Home Health, Home Services, and Home Nursing Agency Licensing Act (210 ILCS 55): As a licensed home health agency in Illinois, we are subject to ongoing state oversight and must maintain records in accordance with state licensing requirements.

In cases where Illinois state law affords you greater privacy protection than HIPAA, we will follow the more protective state standard.

7. Data Security

We are committed to protecting your personal information and PHI through a comprehensive set of administrative, physical, and technical safeguards, as required by HIPAA's Security Rule (45 CFR Parts 160 and 164).

Our security measures include, but are not limited to:

• Role-based access controls limiting PHI access to workforce members with a legitimate need to know.
• Encryption of PHI transmitted electronically over open networks.
• Workforce training on privacy and security obligations upon hire and at least annually thereafter.
• Regular risk assessments and vulnerability analyses of our information systems.
• Documented security incident response and breach notification procedures.
• Physical safeguards for facilities and equipment containing PHI, including locked file storage and visitor access controls.
• Business Associate Agreements with all vendors and contractors who access PHI on our behalf.

Care services for minor clients are delivered pursuant to the written authorization and informed consent of a parent or legal guardian, who will be provided with a copy of this Notice and will exercise HIPAA rights on behalf of the minor client in accordance with Illinois law.

2. Services Described

Regina's Loving Arms Home Health Care, LLC is a licensed home health agency providing the following services in the Chicago metropolitan area:

• Home health aide and caregiver services
• IDoA senior programs
• Companion care and social engagement services
• 24-hour and live-in care programs

All clinical services are provided pursuant to a physician's plan of care and applicable Illinois and federal licensing requirements. The scope, frequency, and type of services provided to each client will be set forth in a written Service Agreement and individualized care plan, which constitute the binding terms of the services to be delivered.

This website is provided for informational purposes only and does not constitute an offer or agreement to provide services. A formal Service Agreement must be executed before care services commence.

3. Client Responsibilities

To enable the safe and effective delivery of care, clients and their authorized representatives agree to:

• Accurate Information: Provide complete, accurate, and up-to-date information about the client's medical history, medications, conditions, and home environment. Failure to do so may compromise the quality and safety of care.
• Safe Environment: Maintain a safe working environment for our caregivers, including appropriate lighting, a smoke-free environment during caregiver visits where possible, and freedom from threatening or abusive behavior. We reserve the right to withdraw services if staff safety is at risk.
• Cooperation with Care Plan: Cooperate with the developed care plan and communicate promptly with your care coordinator if circumstances change or if you wish to modify the plan.
• Authorization: Ensure that all individuals who interact with our staff on your behalf are properly authorized to do so, and inform us promptly of any changes in legal guardianship, power of attorney, or authorized representatives.
• Payment Obligations: Fulfill financial obligations as set forth in your Service Agreement and as described in Section 4 below.
• Compliance with Law: Comply with all applicable local, state, and federal laws in connection with the receipt of our services.

4. Payment & Billing

Payment Sources

We accept payment from Medicare, Illinois Medicaid, most major private insurance carriers, and private-pay arrangements. Applicable rates, billing cycles, and covered services will be set forth in your Service Agreement.

Client Financial Responsibility

You are responsible for any balances not covered by insurance or government programs, including applicable co-payments, deductibles, and services not covered under your plan. We will provide advance notice of any costs that are your responsibility, to the extent reasonably known.

Billing Disputes

If you believe a charge on your bill is inaccurate, please notify our billing department in writing within 30 days of receiving the statement. We will investigate and respond within 30 days of receiving your written dispute.

Non-Payment

Accounts that remain unpaid beyond the terms specified in the Service Agreement may be subject to collection proceedings. We will make reasonable efforts to contact you before initiating any collection action. Pursuit of unpaid balances does not constitute a waiver of any other rights we may have under the Service Agreement or applicable law.

Insurance Claims

As a courtesy, we will submit claims to your primary insurer or government payer on your behalf where applicable. You are responsible for ensuring that we have accurate and current insurance information at all times. We are not responsible for denials arising from inaccurate or outdated information provided by you.

8. Termination of Services

By the Client

You may terminate services at any time by providing written notice to your care coordinator. Notice requirements for scheduled services will be set forth in your Service Agreement. You remain responsible for all charges incurred through the effective date of termination.

By Regina's Loving Arms

We reserve the right to discontinue or suspend services in the following circumstances, with reasonable advance notice where possible:

• Non-payment of amounts owed under the Service Agreement;
• Unsafe working conditions that cannot be reasonably mitigated and that threaten the safety or wellbeing of our staff;
• Client or representative behavior that is abusive, threatening, or discriminatory toward our employees;
• Material misrepresentation of health status, financial information, or insurance coverage;
• Client's care needs that exceed the scope of services we are licensed or equipped to provide, in which case we will make reasonable efforts to assist with transition to an appropriate provider;
• The client's physician discontinues or materially alters the plan of care in a way that renders further services unnecessary or inappropriate.

In cases involving imminent safety risk, we may suspend services immediately and will provide written notice as soon as practicable thereafter.

9. Governing Law & Dispute Resolution

These Terms of Service, and any disputes arising out of or related to them or our services, shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you hereby consent to the personal jurisdiction of those courts.

Grievance Procedure

As a licensed home health agency in Illinois, we maintain a formal grievance procedure. Clients have the right to file a formal complaint regarding the quality of care or services received. Written complaints will be acknowledged within 5 business days and fully investigated within 30 days. You may also file a complaint with the Illinois Department of Public Health at 1-800-252-4343.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
